Cooling Off Period

So what is the cooling off period for timeshare? Well, this term refers to the time when you are able to change your mind about your timeshare contract. After this time you will not be able to cancel your timeshare unless you can prove that the contract was not legal or that you have been involved in a timeshare scam or fraud.

The cooling off period is a legal requirement in most countries to protect consumers from scams, although it is rarely applied as most people do not agree to buy a timeshare and spend a large sum of money unless they are convinced. In any case, this times span is given as days of grace in the same way that stores allow you to return unwanted items.

The length of the cooling off period depends on the country where you purchased the timeshare and can be anything from 7 to 14 days. If in doubt, ask the timeshare developer where you bought your timeshare.

Customer Reviews of Villagroup

The timeshare developer, Villagroup stands in a very strong position with a chain of popular resorts located in the best beach vacation destinations in Mexico. Boasting a reputation that is coveted by most timeshare companies, part of its success comes from dedication to quality, value for money, customer service and an expert sixth sense for what people want from their vacations.

A key factor in Villagroup’s ever growing positive reputation comes from how the company applies information left by timeshare owners when they fill out their client reviews. This review information is important for maintaining high standards and to keep pushing the boundaries of excellence.

One compliment that recurs in the reviews left by Villa del Palmar timeshare owners is how happy guests are with the size of the timeshare accommodations, especially the one or two bedroom suites which have large balconies, kitchens and spacious bedrooms. There are many reviews that make reference to the excellent quality furniture and decoration, which ensures that taking a vacation at a Villa del Palmar resort is like arriving home in paradise.

No matter which Villagroup resort customers visit in Puerto Vallarta, Nuevo Vallarta, Cabo San Lucas, Loreto or Cancun, the timeshare reviews received are generally very positive about the installations at the resort, with comments about the large pools and the excellent spa facilities in particular. In fact, in virtually all of the Villagroup resorts, the spa is one feature that is commonly praised in the customer reviews.

Lastly, one of the reasons that Villagroup tend to rank highly in customer reviews is thanks to the efficient way it deals with customer complaints and its quick problem resolution. The Villagroup’s objective is to resolve problems as quickly as possible with as little inconvenience to timeshare owners as possible. Consequently, reviews are generally positive to this effect.

Types of Timeshare Gifts

To entice you to go to a timeshare presentation or tour, most developers will offer some kind of incentive or free gift. These gifts can be all sorts of things, from discounted tickets, money, vouchers, wine and so on. While it is common to receive some kind of freebie, you should beware of companies that offer over the top gifts as you may find you will be paying the price of the privilege of receiving them in some way!

Signs of a Scam

There is a common saying in the industry that you can smell a timeshare scam a mile away by the gift. Generally, the most popular and genuine timeshare developers are pretty secure about the product they are selling and therefore the gift reflects this position. They do not need to “bribe” people to visit the property and you will find that the chance to visit the resort and enjoy a free breakfast is often enough to entice most people to some of the best timeshare resorts.

If you are asked to pay something towards receiving your gift, such as taxes, delivery or a permit, then you should think very carefully about accepting the gift and certainly avoid buying the timeshare property.

Genuine Timeshare Incentives

A reputable timeshare developer selling a great property will usually be pretty conservative about lavishing gifts on its visitor, secure in the knowledge that simply visiting the resort will be a pleasurable experience. Usually the gifts offered are more realistic and less likely to be used to make you feel guilty about not buying a timeshare unit. Common incentives are discounted tickets for local activities, car hire, restaurant vouchers or a free breakfast at the resort. Nowadays, timeshare companies are less likely to offer cash incentives, although some some still do, but that is usually at the discretion of the timeshare promoter or OPC.

Beware Unsolicited Timeshare Lawyer Phone Calls

A new scam affecting Villa del Palmar timeshare owners and Villa Preferred Access members has come to light that involves Villagroup members being contacted by telephone by a company professing to be a timeshare attorney firm. The Villagroup has issued a warning to its members to be wary of these phone calls which try to extract personal information.

According to Villa del Palmar members who brought the scam to the attention of The Villagroup, the callers claim to be timeshare lawyers or attorneys representing a class action group suing the Villagroup. Such cold calling would not be such an issue if it weren’t for the fact that the “legal” representatives asked members to reveal personal information.

It is too early to tell just how sinister the motives are for this scam, therefore all timeshare owners are advised to beware unsolicited phone calls from timeshare lawyers or attorneys. If you have any doubts, do not reveal any personal information over the telephone and hang up should they become insistent or aggressive. If they are a genuine legal firm with a legitimate concern, they will send you information in writing.

Timeshare Resales Villa del Palmar – The Horrible Truth

If you are thinking of buying a Villa del Palmar resale property in one of The Villa Group‘s 5 destinations throughout Mexico: Puerto Vallarta, Nuevo Vallarta, Cancun, Cabo San Lucas, Loreto, then you should think very carefully about your decision and more importantly do some research about the company that is selling you the property.

On the whole, when buying a Villa del Palmar timeshare from someone you know or through a friend of a friend then you are probably getting a genuine timeshare property, although some of the terms and benefits of the original timeshare ownership package many not apply, like access to vacation club member benefits etc. If, however, you are thinking of buying from a timeshare agent or in response to an add on a timeshare forum or email, then you need to double check all contracts and read the small print very carefully.

Villa del Palmar timeshare properties are very popular, hence why there are many resale scams that involve selling these desirable units. Due to the sheer number of Villa Group resorts throughout Mexico, they are very commonly offered for resale, although you would be much safer to buy directly from the developer to take advantage of all the wider benefits, such as Villa Preferred Access, which basically allows you to exchange your home resort unit for another of the Villa Group’s properties. Most of the time when you buy a resale, you are limited only to the original resort location.

Resale Scams

Another horrible truth about Villa del Palmar resales is the number of deliberate scams there are that target happy timeshare owners as well as those people who are interested in buying a Villa del Palmar timeshare. Timeshare owners are frequently targeted by scammers offering to buy their unit, even though they had no intention of selling. When offered a great unbeatable sum for the property, most of us will consider selling, especially if we bought years ago and will stand to make a great profit. However, these scams catch you for that same reason. You pay a referral fee to gain the details of the potential buyer and then never hear from the resale agent again. Duped!

Legal Rights when Original Owner Dies

Timeshare contracts are not as straightforward as people think. There have been cases where a timeshare has been “sold on” to new owners as a resale, yet when the first owner dies, the timeshare is still officially in his or her name, therefore leaving doubt as to who is the legal inheritor of the timeshare. Family members have been know to bring into question the validity of timeshare resales and you could end up losing your timeshare investment.

Advice on Selling Your Timeshare

Before making any decisions about selling your timeshare, it is important to recognize why you wish to sell. Thinking carefully about your reasons will help you avoid a lot of hard work and trouble. Often our reasons for wanting to sell our timeshare are circumstantial and easily rectified.

Change of Circumstances

Maybe your economic circumstance have changed somewhat since the time when you first bought your timeshare and now you cannot afford to take a vacation every year. Rather than sell your timeshare, you could join a vacation club which will let you bank your timeshare points for the following year, meaning that you take a vacation every two years rather than every year. That way you can stay in a bigger or more luxurious apartment than the one you originally bought and therefore invite friends and family to share the costs.

Another consideration to think about before selling your timeshare is how quickly things can change for the better. Once you have paid for your investment timeshare, then it does not make sense to sell it. Instead you should make the most of your vacations at yesterday’s prices.

Cannot Afford the Maintenance Fees

An easy solution to this predicament is to rent your timeshare to friends and family, charging them only the cost of the maintenance fees. If you want to rent it for a profit then you are best to do so via the Internet or through word of mouth. That way you keep your investment until such a time that you can once again afford the maintenance fees and are able to enjoy your timeshare once again.

Want to Visit Different Places

Nowadays it is very easy to swap your timeshare weeks for other destinations. You can do so through a vacation club or privately through social networks. Vacation clubs or points systems make exchanging your vacation property very easy and flexible.

Bereavement or Divorce

There are frequently emotional reason for no longer wanting to use a timeshare, because of psychological attachments and memories. Rather than selling your timeshare, you may consider a vacation club like Interval International where you could take cruises instead, giving you a completely different experience than the one you shared before.

Inherited Timeshares

You may be in the position that you have inherited a timeshare. Before selling, you should at least visit the timeshare property to decide if you could make good use of it. You might also want to consider donating it to a charity or lending it to other members of your family.

Villa Preferred Access

What is Villa Preferred Access?

This is timeshare points scheme which enables timeshare owners to convert their current Villa del Palmar timeshare into points or to purchase points directly. Villa Preferred Access is an initiative offered by The Villagroup, one of Mexico’s most long standing and reputable timeshare companies.

What is the purpose of Villa Preferred Access?

One of the complaints voiced by people who do not buy a timeshare is that they do not want to return to the same resort year after year. Villa Preferred Access is a direct response to this opinion in that the scheme provides greater flexibility and more options for customers. In a nutshell, your timeshare property is converted into points; that is, the value of your timeshare is given a point score which you can then divide and use as your wish.

What are the benefits of Villa Preferred Access?

Due to the fact that The Villagroup have such an great range of resorts in fantastic beach locations in Mexico, including Cabo San Lucas, Puerto Vallarta, Riviera Nayarit, Cancun and Loreto, the points scheme makes it easier for owners to exchange their timeshare for other destinations. It is then easier for you to transfer your points to an international vacation club, where you can further enhance your exchange possibilities for accommodations globally.

Another clear benefit of Villa Preferred Access is that timeshare owners can become more flexible with their dates. You no longer have to stick to the same 7 days every year and can decide to split your points and therefore take two short vacations in one year, or even save your points for the following year to spend on a more luxurious or bigger property.

Villa Preferred Access responds to the changing needs of more sophisticated vacation schedules. No one want to be trapped by their vacation home, on the contrary, Villa Preferred Access liberates timeshare owners to truly experience their investment.

The Villagroup Complaints Procedures

Like most reputable companies, The Villagroup is keen to resolve customer complaints and disputes in the quickest and most harmonious way possible. The Villagroup is responsible for all the Villa del Palmar resorts in Cabo San Lucas, Puerto Vallarta, Nuevo Vallarta, Loreto and Cancun, Mexico. They have been dealing with happy customers for more than 26 years and their continued success is testimony to their excellent customer service commitment.

Part of the reason for such a clear complaints procedure is precisely because The Villagroup values both its customers as well as its good name. In an industry that receives a lot of bad press, honesty and openness is key to success, and dealing with complaints fairly and efficiently is very important to avoid dissatisfaction.

What to do if you have a complaint

You should first make it clear to a member of staff that you have a problem you wish to be resolved, or a complaint to make. If you are still in the Villa del Palmar resort, you should speak to a member of staff in person who should refer you to a more senior member of staff if they cannot solve your complaint.

If your complaint has not been resolved while you are in Mexico, you would do well to contact the resort via email, telephone or registered post. Always use registered post when sending documents or letters.

Complaints on website forums are not recommended as an efficient course of action as The Villagroup cannot guarantee they will see the complaints and be able to rectify the problem. If you wish to have a quick response, you should deal directly with The Villagroup rather than involve third parties.

Villa del Palmar – Do you really need a class action suit?

When you purchase a timeshare leisure accommodation from any of the Villa del Palmar resorts in the Villagroup chain, you are investing in a lifetime of quality vacations at prices which compete favorably with other timeshare companies. The easy answer to the question posed is that when you buy from Villa del Palmar, there really should be no cause for you to join a class action suit or file legal proceedings individually.

Villa del Palmar sell genuine timeshare accommodations and have a strict sales policy, being very careful not to mis-sell or misrepresent their product. With nearly 30 years in the business, you can rely on the quality of their product and the reliability of the services they offer. If you have been unfortunate enough to be approached by a maverick seller, then you will probably find that Villa del Palmar have already fired the employee and in that case, your best course of action is to deal directly with Villagroup to see how they can resolve your issue. It is also important that you inform Villa del Palmar of any complaints you have about the presentation or sales procedure in order to improve services in the future.

Class action suits are highly recommended for deliberate scams and timeshare fraud, such as cases where street promoters sell timeshare units that don’t exist or in resorts where they do not have the right to sell. When you have been involved in a scam, you will probably find that the bogus or fraudulent company will also be facing criminal proceedings. In those cases a class action suit would be a good option, so long as you select your timeshare lawyer carefully and avoid internet companies claiming to cancel timeshare contracts.

So, if you are considering a class action suit against a genuine timeshare operator like Villa del Palmar, the likelihood of winning is quite slim and you will probably find greater satisfaction dealing directly with the company. Class action suits against legitimate companies can end up costing you more money than your maintenance fees and with little to show for your efforts. Beware of the promises made by timeshare lawyers who approach you or who advertise on Internet forums; they will earn their fee no matter whether you win or lose!

Thanksgiving in Puerto Vallarta

Getting away from it all at Thanksgiving is a great opportunity to reset the batteries and enjoy quality time with the family. The long weekend in November in the US and October in Canada means that you can take advantage of the extra vacation time to escape for a couple of days or extend a longer trip.

Puerto Vallarta is a destination that caters perfectly for the Thanksgiving holidays, with relatively short and direct flights from many North American cities and a selection of excellent hotels, resorts and vacation rentals to choose from for all budgets.

On the Pacific Coast, Puerto Vallarta benefits from stunning beaches all with their distinct characters. Some beaches are perfect family beaches, like in Nuevo Vallarta where the sea is shallow and the waves are fun but light, others are great for surfing, while some beaches are deeper with light currents great for lounging on an inflatable mat.

You will find that Puerto Vallarta is very accommodating for visitors arriving to celebrate Thanksgiving. Most hotels and restaurants will prepare a special menu with turkey and all the trimmings and many places will have special events or live music to celebrate. As Thanksgiving is not a national holiday in Mexico, you will benefit from the exclusivity and specialized services offered. It is not so difficult to make reservations in the best restaurants and there is a sense of patriotic unification between visitors enjoying Thanksgiving that is heartwarming.

Canceling Your Timeshare Contract

Whether or not you are able to cancel your timeshare contract will depend on various factors: the country where the contract was signed, the length of time since you signed the contract and whether there are any lawful reasons for you to forfeit the contract.

The first thing to consider if you are a timeshare owner is whether you really want to cancel your contract. Many people get cold feet when they get home after making their first timeshare purchase but are glad they did not cancel once they begin to enjoy the benefits of their home away from home.

If you have thought about it carefully and have decided that vacation ownership is definitely not for you, and you are within the official cooling off period (which depends on the country and can be as little as 5 business days and usually no longer than two weeks), then you may be able to null and void your contract. You will need to contact the timeshare developer or agent from whom you bought your property and to request what they require to cancel the contract. In all cases you will be expected to send written notification with proof of delivery.

Unfortunately, if you have gone beyond the cushion of the cooling off period then it is very unlikely that you will be able to cancel your timeshare, that is, unless you have been grossly miss-sold or you have evidence of a deliberate scam or fraud, as in the case of non-existence resorts or unfinished properties. You will need to contact a timeshare lawyer or attorney in order to begin proceedings. For this, beware of companies that approach you claiming to cancel your timeshare, always work through a legitimate lawyer.

Another common misconception is that instead of canceling your timeshare you can simply stop paying the maintenance fees. However, this will bring about legal proceedings against you for the cost of unpaid fees and legal costs, and will cause more problems in any case calling for your contract to be cancelled.

If you are sure you no longer want your timeshare, other solutions rather than cancellation are to donate your timeshare, sell it, lend or rent it to friends and family or transfer the rights of the timeshare permanently to someone you know.

The main thing to remember when seeking to cancel your timeshare contract is that like any legally binding agreement, you need to have grounds for canceling and evidence to support any intentional mis-selling. Always act as quickly as possible and don’t trust companies that say it is easy to cancel your contract, they are probably scams of some kind.

The Myths Exposed About Maintenance Fees

Timeshare maintenance fees seem to get a lot of bad press, with complaints ranging from simply having to pay them to accusations that buyers were never informed about maintenance fees at the time of purchase. The unavoidable fact is that maintenance fees are unavoidable whether in a fully owned private condo or a timeshare complex. One way or another your property has to be repaired, conditioned and generally maintained so that when you do use it, your experience is one worth having.

So let’s take a look at some of the common myths associated with maintenance fees:

1. Optional

Unfortunately and fortunately, maintenance fees are not optional. All owners are expected to pay their share of the maintenance costs. In timeshare properties this is divided between all owners so as to make it a reasonable cost to ensure that your unit is just as you like it when you take your next vacation.

Also, it is important to note that legally you do not have an option to stop paying your maintenance fees. If you fail to keep up with your payments you are likely to face legal proceedings.

2. Waste of Money

Maintaining your property is part of securing your initial investment. Over time, furniture and the installations will naturally deteriorate, and timeshare maintenance fees ensure that all the necessary repairs are kept up to date. Your fees also cover the replacement of furniture and other appliances, so that your property looks as good as new.

3. A Scam

Many people see maintenance fees as a scam. However, all buyers of timeshare properties from reputable companies should be made fully aware of the need to pay maintenance fees; in addition to which the information should be clearly stated in the initial contract. Maintenance fees are not scams but a necessary part of your long term enjoyment.

It is worth noting that scams may arise if the timeshare resort has not yet be finished and you are paying fees to maintain a property that does not exist, nor likely to be finished. If you suspect that you have been subject to a deliberate scam, then you should contact a lawyer or timeshare attorney.

Remains of Ancient Civilizations Around Cancun

Cancun has so much more to offer than the usual Caribbean paradise. Besides the breathtaking azure hues of the sea contrasting with the snow-white sands that are native to the whole Yucatan area, Cancun is surrounded by a host of fascinating ancient ruins dating back hundreds of years.

The ancient and mystical civilization of the Maya has left a enigmatic mark on the whole region with sacred temples and pyramids dotted throughout. The Mayan empire controlled a vast domain, which spanned what are now the southern states of Mexico, Guatemala, Belize, Honduras and some parts of Salvador. In its time, the civilization was considered at the height of progress, having developed a sophisticated written language, mathematics, geometry, astronomy and science.

In Cancun, there are two principal sites of interest where you can see first hand the remains of this revered culture. El Rey and El Meco. El Rey dates back to the year 900 AD, and was named after the Mayan sun god when excavators found a ceremonial mask and skull while El Meco was an old trading port for links with Isla Mujeres.

A couple of hours drive from Cancun, you will find Chichen Itza, arguably the most well known of all the ancient Mayan ruins, whose central pyramid is a common sight on postcards in and around Cancun. Chichen Itza is considered to have been one of the largest Mayan cities, with an area of nearly 2 square miles. Taking a tour of the sacred site is a must when you visit Cancun. The buildings are incredibly well preserved and you can easily imagine what life was like hundreds of years before.

If you only have a short time in Cancun and want to spend as much time as possible getting a tan on the beach, Tulum would be a great compromise. These Mayan temples are actually located on the beach in Tulum with the Caribbean as their beautiful backdrop. After a couple hours of cultural musing, you can spend the rest of the day enjoying the beach.

Certified Beaches On the Pacific Coast of Mexico

Mexico has a department in charge of ensuring that the beaches in the main tourist areas meet strict standards of cleanliness and quality. This year, 2013 the Interstate Clean Beach Committee Meeting LXVII commended the states of Jalisco and Nayarit for their commitment to the cleanliness of their beaches.

Ten beaches in the Banderas Bay area were certified by the Mexican Institute of Standardization and Certification (IMNC) in accordance with standard: NMX-AA-120-SCFI-2006, leading the country in its pledge to ensure the cleanliness of Mexico’s coastline. In 2013, there were four beaches certified in Puerto Vallarta in addition to six beaches in Nuevo Vallarta.

IMNC sends accredited evaluators to assess beaches for their cleanliness (including sand and sea water), municipal wastewater treatment and disposal, clean up programs, safety and policing. Beaches that receive the coveted certification will have meet all of these criteria including having a no fishing policy, vegetation that is natural to the region and the results of water sample testing for the public to see.

This is a great step forward for hotels and resorts in Puerto Vallarta and Nayarit as the standards of their beaches take center stage. Visitors to beaches in Banderas Bay can also trust the quality of the beaches and swim in the ocean without fear of an infection or disagreeable experience.

Vallarta Weather

Puerto Vallarta or Vallarta as it is known by the locals is celebrated for its great sunny climate all through the year. It is very popular amongst North Americans escaping from the winter gloom and freezing temperatures in favor of guaranteed pleasant, sunny weather.

A tropical savanna climate, Puerto Vallarta has wet summers and dry winters, which is a great combination as it never gets too hot nor too cold. The average temperatures quoted for Puerto Vallarta are highs of 91ºF (33ºC) and lows of 61ºF (16ºC) with temperatures seldom falling under 57ºC (14ºC) or soaring above 93ºF (34ºC). Sounds perfect, doesn’t it?

For many, the best times to visit Puerto Vallarta are during the dry winters or from November to February, especially as you can guarantee sunshine, while during the summer months the ocean is warm and the tropical thunderstorms at night are magical. The good thing about rain in Puerto Vallarta is that it rarely stays wet all day, and showers are usually heavy and short lived, meaning you will get plenty of sunshine during a vacation during the rainy season.

Cancun Climate

You just cannot beat a sunny beach getaway and Cancun promises just that, whatever season! The climate in Cancun is reported to be the best of all the Caribbean destinations, boasting the most sunny day days on average. Both the sea and the air temperatures are warm no matter what times of the year you visit, making it the perfect choice for a winter vacation yet still pleasant during the summer season.

Statistics claim that Cancun has around 240 days of sunshine throughout the year and so you can be sure that the sun will shine on your vacation. It is not at all common for you to experience bad weather for the whole time you visit Cancun, which is why it is such a popular choice.

The length of the day does not fluctuate a great deal from the summer months to the winter, with 13 hours of daylight during summer as opposed to 11 hours in winter. If you suffer from seasonal affective disorder or SAD, a visit to Cancun could be just what the doctor ordered.

The temperature in Cancun is also very pleasant, although it can get very humid (which is great for wrinkles!), ranging from lows of 66ºF (19ºC) to highs of 91ºF (33ºC). In winter you will find that temperatures are pretty balmy, around 81ºF (27ºC) with an average low of 66ºF (19ºC).

Rain is a common concern for people planning on where to take a vacation and while it might rain during any time of the year in Cancun, you will find that it is not cold, dismal rain like in the States or Canada but more like warm light to moderate showers, followed by sunshine. Statistics also claim that Cancun experiences only an average of about 60 days of rain a year. However, it is worth noting that Cancun does have a hurricane season which can bring breathtaking electrical storms from June through November, and also put a spanner in the works if you are unlucky.

Do I have to pay tax on a timeshare gift?

The common technique for time share developers to employ to persuade people to attend a time share presentation is to offer a gift of some sort. Up until now, there have been no legal taxes imposed on time share gifts and you should not believe anyone who tells you that you will have to pay such a tax at the airport before leaving a destination.

Time share gifts usually include complimentary meals, free excursions, discounts on accommodations, free bottles of alcohol, bicycles, and so on, all of which would be difficult to tax, even if there was such a law. A grey area comes with cash incentives, although most reputable time share companies offer money or vouchers that are redeemable against the purchase of a property rather than physical cash.

In most cases, if you are threatened with having to pay tax on your gifts at the airport, this is likely to be a scam to get you to return your free gifts. Avoid unpleasant time share experiences and chose a reputable company with a good track record.

Time Share Scams Explained

It seems that many people see time share as a scam when in reality the scheme is a genuine offer and those who have been ripped off have had the unfortunate experience of meeting with a deliberate fraud. Buying with a reputable time share company with a long track record will keep you safe from being swindled.

In fact, if time share suits your vacation needs, it is a far from a scam and can actually save you money and time in the future. Nevertheless, the real benefit of buying a time share is not to save money but to raise the quality of your vacation experience and invest in time with your loved ones.

Even so, there are those who have experienced a deliberate time share scam, so let’s take a look at some of the ways to save yourself from a time share scam.

Most time share scams are related to selling your time share property. For example, you may get a telephone call from an agent who claims they have a buyer who wants to buy your time share. You may not have even considered selling but if the price is right, you might well take the bait. In order to receive the information of the buyer you have to pay an introduction fee, and there goes your money! You never hear from the agent again.

Some time share scams relate to the gift you receive to attend a presentation. You go to the presentation and decide not to buy a property but are still entitled to your free gift. Some companies charge you a hefty delivery fee, which costs more than the gift is worth. Other scams involve having to pay to enter a raffle in order to win your free gift. These kinds of scams are getting less common as time share companies are recognizing the need to protect their reputations and trust that the properties should simply sell themselves.
