Canceling Your Timeshare Contract

Whether or not you are able to cancel your timeshare contract will depend on various factors: the country where the contract was signed, the length of time since you signed the contract and whether there are any lawful reasons for you to forfeit the contract.

The first thing to consider if you are a timeshare owner is whether you really want to cancel your contract. Many people get cold feet when they get home after making their first timeshare purchase but are glad they did not cancel once they begin to enjoy the benefits of their home away from home.

If you have thought about it carefully and have decided that vacation ownership is definitely not for you, and you are within the official cooling off period (which depends on the country and can be as little as 5 business days and usually no longer than two weeks), then you may be able to null and void your contract. You will need to contact the timeshare developer or agent from whom you bought your property and to request what they require to cancel the contract. In all cases you will be expected to send written notification with proof of delivery.

Unfortunately, if you have gone beyond the cushion of the cooling off period then it is very unlikely that you will be able to cancel your timeshare, that is, unless you have been grossly miss-sold or you have evidence of a deliberate scam or fraud, as in the case of non-existence resorts or unfinished properties. You will need to contact a timeshare lawyer or attorney in order to begin proceedings. For this, beware of companies that approach you claiming to cancel your timeshare, always work through a legitimate lawyer.

Another common misconception is that instead of canceling your timeshare you can simply stop paying the maintenance fees. However, this will bring about legal proceedings against you for the cost of unpaid fees and legal costs, and will cause more problems in any case calling for your contract to be cancelled.

If you are sure you no longer want your timeshare, other solutions rather than cancellation are to donate your timeshare, sell it, lend or rent it to friends and family or transfer the rights of the timeshare permanently to someone you know.

The main thing to remember when seeking to cancel your timeshare contract is that like any legally binding agreement, you need to have grounds for canceling and evidence to support any intentional mis-selling. Always act as quickly as possible and don’t trust companies that say it is easy to cancel your contract, they are probably scams of some kind.

The Myths Exposed About Maintenance Fees

Timeshare maintenance fees seem to get a lot of bad press, with complaints ranging from simply having to pay them to accusations that buyers were never informed about maintenance fees at the time of purchase. The unavoidable fact is that maintenance fees are unavoidable whether in a fully owned private condo or a timeshare complex. One way or another your property has to be repaired, conditioned and generally maintained so that when you do use it, your experience is one worth having.

So let’s take a look at some of the common myths associated with maintenance fees:

1. Optional

Unfortunately and fortunately, maintenance fees are not optional. All owners are expected to pay their share of the maintenance costs. In timeshare properties this is divided between all owners so as to make it a reasonable cost to ensure that your unit is just as you like it when you take your next vacation.

Also, it is important to note that legally you do not have an option to stop paying your maintenance fees. If you fail to keep up with your payments you are likely to face legal proceedings.

2. Waste of Money

Maintaining your property is part of securing your initial investment. Over time, furniture and the installations will naturally deteriorate, and timeshare maintenance fees ensure that all the necessary repairs are kept up to date. Your fees also cover the replacement of furniture and other appliances, so that your property looks as good as new.

3. A Scam

Many people see maintenance fees as a scam. However, all buyers of timeshare properties from reputable companies should be made fully aware of the need to pay maintenance fees; in addition to which the information should be clearly stated in the initial contract. Maintenance fees are not scams but a necessary part of your long term enjoyment.

It is worth noting that scams may arise if the timeshare resort has not yet be finished and you are paying fees to maintain a property that does not exist, nor likely to be finished. If you suspect that you have been subject to a deliberate scam, then you should contact a lawyer or timeshare attorney.

Remains of Ancient Civilizations Around Cancun

Cancun has so much more to offer than the usual Caribbean paradise. Besides the breathtaking azure hues of the sea contrasting with the snow-white sands that are native to the whole Yucatan area, Cancun is surrounded by a host of fascinating ancient ruins dating back hundreds of years.

The ancient and mystical civilization of the Maya has left a enigmatic mark on the whole region with sacred temples and pyramids dotted throughout. The Mayan empire controlled a vast domain, which spanned what are now the southern states of Mexico, Guatemala, Belize, Honduras and some parts of Salvador. In its time, the civilization was considered at the height of progress, having developed a sophisticated written language, mathematics, geometry, astronomy and science.

In Cancun, there are two principal sites of interest where you can see first hand the remains of this revered culture. El Rey and El Meco. El Rey dates back to the year 900 AD, and was named after the Mayan sun god when excavators found a ceremonial mask and skull while El Meco was an old trading port for links with Isla Mujeres.

A couple of hours drive from Cancun, you will find Chichen Itza, arguably the most well known of all the ancient Mayan ruins, whose central pyramid is a common sight on postcards in and around Cancun. Chichen Itza is considered to have been one of the largest Mayan cities, with an area of nearly 2 square miles. Taking a tour of the sacred site is a must when you visit Cancun. The buildings are incredibly well preserved and you can easily imagine what life was like hundreds of years before.

If you only have a short time in Cancun and want to spend as much time as possible getting a tan on the beach, Tulum would be a great compromise. These Mayan temples are actually located on the beach in Tulum with the Caribbean as their beautiful backdrop. After a couple hours of cultural musing, you can spend the rest of the day enjoying the beach.

Certified Beaches On the Pacific Coast of Mexico

Mexico has a department in charge of ensuring that the beaches in the main tourist areas meet strict standards of cleanliness and quality. This year, 2013 the Interstate Clean Beach Committee Meeting LXVII commended the states of Jalisco and Nayarit for their commitment to the cleanliness of their beaches.

Ten beaches in the Banderas Bay area were certified by the Mexican Institute of Standardization and Certification (IMNC) in accordance with standard: NMX-AA-120-SCFI-2006, leading the country in its pledge to ensure the cleanliness of Mexico’s coastline. In 2013, there were four beaches certified in Puerto Vallarta in addition to six beaches in Nuevo Vallarta.

IMNC sends accredited evaluators to assess beaches for their cleanliness (including sand and sea water), municipal wastewater treatment and disposal, clean up programs, safety and policing. Beaches that receive the coveted certification will have meet all of these criteria including having a no fishing policy, vegetation that is natural to the region and the results of water sample testing for the public to see.

This is a great step forward for hotels and resorts in Puerto Vallarta and Nayarit as the standards of their beaches take center stage. Visitors to beaches in Banderas Bay can also trust the quality of the beaches and swim in the ocean without fear of an infection or disagreeable experience.

Vallarta Weather

Puerto Vallarta or Vallarta as it is known by the locals is celebrated for its great sunny climate all through the year. It is very popular amongst North Americans escaping from the winter gloom and freezing temperatures in favor of guaranteed pleasant, sunny weather.

A tropical savanna climate, Puerto Vallarta has wet summers and dry winters, which is a great combination as it never gets too hot nor too cold. The average temperatures quoted for Puerto Vallarta are highs of 91ºF (33ºC) and lows of 61ºF (16ºC) with temperatures seldom falling under 57ºC (14ºC) or soaring above 93ºF (34ºC). Sounds perfect, doesn’t it?

For many, the best times to visit Puerto Vallarta are during the dry winters or from November to February, especially as you can guarantee sunshine, while during the summer months the ocean is warm and the tropical thunderstorms at night are magical. The good thing about rain in Puerto Vallarta is that it rarely stays wet all day, and showers are usually heavy and short lived, meaning you will get plenty of sunshine during a vacation during the rainy season.

Cancun Climate

You just cannot beat a sunny beach getaway and Cancun promises just that, whatever season! The climate in Cancun is reported to be the best of all the Caribbean destinations, boasting the most sunny day days on average. Both the sea and the air temperatures are warm no matter what times of the year you visit, making it the perfect choice for a winter vacation yet still pleasant during the summer season.

Statistics claim that Cancun has around 240 days of sunshine throughout the year and so you can be sure that the sun will shine on your vacation. It is not at all common for you to experience bad weather for the whole time you visit Cancun, which is why it is such a popular choice.

The length of the day does not fluctuate a great deal from the summer months to the winter, with 13 hours of daylight during summer as opposed to 11 hours in winter. If you suffer from seasonal affective disorder or SAD, a visit to Cancun could be just what the doctor ordered.

The temperature in Cancun is also very pleasant, although it can get very humid (which is great for wrinkles!), ranging from lows of 66ºF (19ºC) to highs of 91ºF (33ºC). In winter you will find that temperatures are pretty balmy, around 81ºF (27ºC) with an average low of 66ºF (19ºC).

Rain is a common concern for people planning on where to take a vacation and while it might rain during any time of the year in Cancun, you will find that it is not cold, dismal rain like in the States or Canada but more like warm light to moderate showers, followed by sunshine. Statistics also claim that Cancun experiences only an average of about 60 days of rain a year. However, it is worth noting that Cancun does have a hurricane season which can bring breathtaking electrical storms from June through November, and also put a spanner in the works if you are unlucky.

Do I have to pay tax on a timeshare gift?

The common technique for time share developers to employ to persuade people to attend a time share presentation is to offer a gift of some sort. Up until now, there have been no legal taxes imposed on time share gifts and you should not believe anyone who tells you that you will have to pay such a tax at the airport before leaving a destination.

Time share gifts usually include complimentary meals, free excursions, discounts on accommodations, free bottles of alcohol, bicycles, and so on, all of which would be difficult to tax, even if there was such a law. A grey area comes with cash incentives, although most reputable time share companies offer money or vouchers that are redeemable against the purchase of a property rather than physical cash.

In most cases, if you are threatened with having to pay tax on your gifts at the airport, this is likely to be a scam to get you to return your free gifts. Avoid unpleasant time share experiences and chose a reputable company with a good track record.

Time Share Scams Explained

It seems that many people see time share as a scam when in reality the scheme is a genuine offer and those who have been ripped off have had the unfortunate experience of meeting with a deliberate fraud. Buying with a reputable time share company with a long track record will keep you safe from being swindled.

In fact, if time share suits your vacation needs, it is a far from a scam and can actually save you money and time in the future. Nevertheless, the real benefit of buying a time share is not to save money but to raise the quality of your vacation experience and invest in time with your loved ones.

Even so, there are those who have experienced a deliberate time share scam, so let’s take a look at some of the ways to save yourself from a time share scam.

Most time share scams are related to selling your time share property. For example, you may get a telephone call from an agent who claims they have a buyer who wants to buy your time share. You may not have even considered selling but if the price is right, you might well take the bait. In order to receive the information of the buyer you have to pay an introduction fee, and there goes your money! You never hear from the agent again.

Some time share scams relate to the gift you receive to attend a presentation. You go to the presentation and decide not to buy a property but are still entitled to your free gift. Some companies charge you a hefty delivery fee, which costs more than the gift is worth. Other scams involve having to pay to enter a raffle in order to win your free gift. These kinds of scams are getting less common as time share companies are recognizing the need to protect their reputations and trust that the properties should simply sell themselves.
